New groundwater directives and stringent planning regulations place an increasing onus on local authorities and church bodies to undertake extensive site studies prior to the extension or development of a new cemetery.

For example:

  • under the groundwater Regulations Act (1998), the Environment Agency has powers to take action where groundwater pollution occurs or is likely to occur
  • under the Water Resources Act (1991) the Environment Agency requires pollution prevention measures to be taken

The scale and extent of these studies are determined by the risks identified. For the development of new graveyards or extensions into new ground the Environment Agency may require up to three tiers of assessments according to the complexities of the site and the risks determined.
